Are predictive auto-dialers legal?

A visitor writes . . . are your products even legal? I thought auto-dialers were outlawed. Isn’t that what your BroadcastByPhone tool is, a predictive auto-dialer?

ANSWER: Shhh! Ixnay on the illegalhay!

Just kidding. Actually, we are firm believers that illegal marketing practices are also stupidly bad marketing practices.

All of our broadcast tools are sold not just with the understanding that they will be used legally, but with tools to help you use them legally.

For example, all of our broadcast tools are sold with a Do No Call List scrubber, which allows you to easily compare your call list to the national list and automatically remove numbers found on the DNC list.

You can also run your list against your own state, regional or personal DNC list, if you have one.

Mobile text messaging tools such as Voicent’s BroadcastBySMS are not yet subjected to legal restrictions, but the national Mobile Marketing Association is developing standards and we expect to eventually see text-message marketing regulations similar to those imposed on email marketing.

We suggest users of our BroadcastBySMS tool do the right thing now–before you are legally required–and only market to those who have opted-in to receive text messages from you.

Voicent’s BroadcastBySMS and BroadcastByEmail tools are designed for customer-relationship management value. Being able to send customers delivery confirmation and other important info through mobile texting is a great convenience for your customers.

And being able to send customers regular email newsletters on topics important to them is a great service for your customers.

On the other hand, few things are more irritating that getting unsolicited marketing text messages on your mobile phone (especially if your texting plan requires you to pay for each message!)

And unsolicited email? There’s a name for that. It’s called SPAM!  No decent human being wants to be a spammer.

Voicent’s BroadcastByEmail tool has several features to help you meet the requirements of the federal Can-Spam Act, including the ability to automatically honor recipient requests to be removed from your email lists.
